I don't understand why a inventer has to disclose to this imaginary designer of ordinary skill. If you make design changes to lets say a form of art that you make,it's been around for over fifty years without any marketing sucess. Then I would think the person who can create the market should be protected, not the person that did nothing, especially a designer of ordinary skill that could not ordinarally look at the design like anybody else, and make the changes himself. What do examiners do give instuctions to people so they can say oh! I can do that, oh by the way do we have a list of all the people in the United States that can follow instructions. I guess were all designers or ordinary skill.

Test takers report the following subject matter on the exam: Know that foreign priority for a design patent is only 6 months not 12 like utility patent.

1502.01 Distinction Between Design and Utility Patents, (F) Foreign priority under 35 U.S.C. 119(a)-(d) can be obtained for the filing of utility patent applications up to 1 year after the first filing in any country subscribing to the Paris Convention, while this period is only 6 months for design patent applications (see 35 U.S.C. 172).
